OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SITE IS LIMITED TO $100, EXCEPT WHERE APPLICABLE LAW REQUIRES A GREATER AMOUNT.

Termination

Sections that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification) will survive.
Governing Law and Venue
These Terms and any disputes arising from them are governed by the laws of the State of Ohio, without regard to conflict of law principles. You and Radon Be Gone agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in Ohio.
Arbitration and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the parties’ relationship will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except where prohibited by law. You and Radon Be Gone each waive the right to a jury trial. You also agree to bring any arbitration on an individual basis only; class, collective, or representative actions are not permitted. If you do not wish to be bound by this arbitration agreement, you may opt out by notifying us in writing within 30 days of first agreeing to these Terms. Email opt-out requests to privacy@radonbegoneoh.com and include your name, address, and the email address used on the Site.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with any policies or other terms posted on the Site (including our Privacy Policy), constitute the entire agreement between you and Radon Be Gone regarding the Site, superseding any prior agreements.
